CONTENTIOUS PRACTICE

When a dispute arises, you are not alone.

At AA Legal, we understand that a legal dispute is not merely a case file — it represents a business at risk, assets under pressure, and decisions that leave no margin for error. Our Contentious Practice is built on two non-negotiable pillars: technical rigor and genuine commitment to every client.

We defend the interests of companies, entrepreneurs, and property owners with the conviction of those who understand what is at stake. Knowing the law is where we begin — guiding our clients through it is our responsibility.

Civil Litigation

Civil disputes share a common characteristic: by the time they surface, they have often been developing for some time. A poorly performed contract, an unpaid debt, a property dispute that was deferred too long. At AA Legal, we address these matters with the technical precision they require and the strategic clarity our clients need to make informed decisions.

From our base in Guadalajara, Jalisco, we represent clients in contractual disputes, monetary collection actions, enforcement of judgments, non-contractual civil liability, rescission and nullification of contracts, restitution actions, possessory actions, and conflicts involving real property, easements, and real rights — with reach across the entire national territory. We pursue interim measures, precautionary attachments, and provisional remedies when the urgency of the matter demands it.

We evaluate every case with candor — because the most effective solution is not always the most protracted one, and our commitment is to the outcome, not the process.

Commercial Litigation

Commercial relationships are the lifeblood of business. When they break down, the consequences extend beyond financial loss — they compromise operations, reputation, and in many cases the very continuity of the enterprise. Our commercial litigation practice is designed to respond with speed, precision, and a thorough understanding of business realities.

We litigate disputes arising from breach of commercial contracts, bill of exchange and promissory note enforcement actions, nullification of corporate acts, challenges to shareholder resolutions, conflicts among partners and shareholders, liability of directors and board members, and disputes arising from mergers, spin-offs, and acquisitions. Our experience working from within organizations enables us to build arguments that go beyond legal doctrine — and this is reflected in our results.

Family Law Litigation

Family disputes with significant patrimonial implications demand an uncommon combination: equal measures of human sensitivity and juridical precision. At AA Legal, we recognize that every proceeding involves people — not merely parties — and we act accordingly.

We represent clients in no-fault and fault-based divorce proceedings, liquidation of the marital property regime and separation of assets, child support, custody and visitation arrangements, paternity recognition, and succession disputes involving family and business assets, including will challenges and estate partition proceedings. We provide absolute discretion, substantive presence at every stage, and a strategy tailored to the specific circumstances of each case.

Administrative Litigation

The relationship between businesses and governmental authorities can become contentious without warning. An adverse administrative ruling, a regulatory sanction, or an act of authority affecting business operations requires an immediate and well-grounded legal response.

We handle administrative appeals and reconsideration proceedings, nullity actions before the Federal Court of Administrative and Tax Justice on grounds of incompetence, abuse of authority, or procedural violations, and disputes with federal and state agencies in tax, regulatory, and foreign trade matters.

We also conduct State patrimonial liability proceedings under the Federal Law on State Patrimonial Liability — cases in which irregular government action causes real and quantifiable harm to individuals or companies. Where the State has acted unlawfully at measurable cost, there is a legal avenue to demand redress — and we know how to pursue it.

Labor Litigation

A poorly handled labor dispute does not only cost money — it affects the work environment, the company's reputation, and the relationship with the people who keep it running every day. When that happens, the legal response must be as strategic as it is measured.

From Guadalajara, Jalisco, we provide comprehensive employer-side defense before the IMSS, INFONAVIT, and the Labor Tribunals. We handle proceedings for unjustified dismissal, termination of employment, statutory benefits claims, reinstatement orders, collective disputes, strike notices, and labor authority audits — under the new oral system that transformed labor justice in Mexico.

Our approach always weighs the true cost of litigation against the merits of a well-negotiated resolution. Because defending a company well does not always mean going to court — sometimes it means knowing when not to.

Agrarian Litigation

A significant portion of Mexico's land is ejidal in nature. For entrepreneurs, developers, and investors seeking to acquire or develop land in the country, that is not an obstacle — it is an opportunity that must be properly structured from a legal standpoint.

At AA Legal, we are agrarian law specialists with a national reach. We accompany companies and investors in the acquisition of ejidal land, adoption of full ownership, regularization before the National Agrarian Registry, and disincorporation of ejidal assets. When disputes arise, we litigate — parcel rights conflicts, urban plot disputes, ejido assembly nullifications, and dispossession actions before the Unitary Agrarian Tribunals.

We know Mexican agrarian law from the inside. That makes the difference.

Criminal Litigation

Facing criminal proceedings — whether as a victim or as a defendant — is among the most demanding circumstances a person or company can encounter. Uncertainty is high, timelines are critical, and the margin for error is virtually nonexistent. In this context, the quality of legal representation is not incidental — it is determinative.

Our criminal practice focuses on offenses of a patrimonial and corporate nature under the adversarial accusatory system: general and specific fraud, breach of fiduciary duty, fraudulent administration, extortion, aggravated theft, tax offenses under the Federal Tax Code, and offenses attributable to legal entities under applicable legislation. We act at every stage of the proceedings — initial investigation, case file, initial hearing, intermediate phase, and oral trial — with speed, clear strategy, and the capacity to integrate criminal with commercial and civil dimensions when the case so requires.

Amparo

The amparo proceeding is the most powerful legal remedy available under the Mexican system. Properly deployed, it can stay a proceeding, overturn a ruling, and fundamentally alter the trajectory of a case. Improperly filed, it can permanently foreclose doors that will never open again.

At AA Legal, we file direct and indirect amparo proceedings in civil, commercial, administrative, tax, labor, and agrarian matters — from Guadalajara, Jalisco, with national reach. We manage the suspension of the challenged act, formulate constitutional violation arguments, and pursue review appeals before Circuit Collegiate Courts and the Supreme Court of Justice of the Nation when the matter demands it.

We assess the merits of every case with full objectivity before recommending this remedy — because a well-filed amparo can change everything, and a poorly conceived one can cost everything.
